Privacy policy

Keuer Solutions Pty Ltd (ABN 48 698 704 853), trading as SWMS NZ (“we”, “us”), operates this website. We supply document templates to New Zealand businesses, so we handle personal information in accordance with the Privacy Act 2020 (New Zealand), which applies to an overseas business carrying on business in New Zealand. We also apply the standards in the Privacy Act 1988 (Australia) and the Australian Privacy Principles to how we handle your information, whether or not that Act applies to us on its own terms.

What we collect

When you purchase, our payment processor collects your name, email address and payment details. We receive your name and email address for order fulfilment, invoicing and communication. We do not see or store card numbers.

At checkout you may opt in to occasional product updates from us. This is optional and does not affect your purchase or downloads.

When you contact us, we keep your message and address so we can reply.

When you browse, our host (Cloudflare) records standard server and security information such as the pages requested, the time, the referring page and a general location derived from your IP address. This is used to keep the site available and to block abuse. We do not use advertising trackers, and we do not build a profile of you.

How we use it

• To deliver purchased products by download link and to send order confirmations and invoices.
• To notify purchasers of corrections or updates to documents they bought.
• To respond to enquiries.
• If you opted in, to send occasional messages about new products or offers. You can unsubscribe at any time.

We do not sell, rent or share your personal information with third parties for marketing.

Marketing messages

Commercial electronic messages are sent only with your consent, identify us as the sender and include a working unsubscribe facility, as required by the Unsolicited Electronic Messages Act 2007 (NZ) and the Spam Act 2003 (Australia). Unsubscribing does not stop transactional messages such as download links, invoices and correction notices.

Third-party processors

We use a small number of service providers, described here by the service they perform: payment processing, website hosting and file storage, security and bot protection, and transactional email delivery. Each handles information under its own privacy terms and only for the purpose we engage it for. Some are located outside New Zealand, including in the United States, so your information may be stored or processed overseas. We keep a register of the providers we use and will tell you who they are on request.

Cross-border disclosure

Because our processors are overseas, your personal information may be stored or processed outside New Zealand, including in the United States. Before disclosing personal information to an overseas person we take the steps required by information privacy principle 12 of the Privacy Act 2020, including satisfying ourselves that the recipient is subject to comparable safeguards. Where the Australian Privacy Principles apply to us, we also meet the equivalent obligation in Australian Privacy Principle 8. That depends on our own coverage under the Australian Act, not on where you happen to be when you contact us.

Cookies and content loaded from other sites

We use a small number of strictly necessary items only: your cart is kept in your browser’s local storage so it survives a page reload, and our security provider sets a cookie to tell real visitors from automated traffic. We do not set advertising or cross-site tracking cookies, and we do not run an analytics product, which is why this site does not ask you to accept cookies. Clearing your browser storage empties your cart and nothing else.

Two things on the site are served by other companies, and your browser requests them directly, so those companies receive your IP address and browser details. The site’s fonts are loaded from a font hosting service on every page. The contact form uses a bot-protection check, loaded on that page only, to stop automated submissions. Neither is used for advertising, and neither tells us anything about you beyond what the page already handles. We are moving the fonts onto our own hosting so that request goes away.

Data security

Payment card details never reach us; they are entered on our payment processor’s own checkout. The site is served over HTTPS. Order records and download links are held in access-controlled storage, and download links are time limited and limited in number of uses. No system is perfectly secure, and we cannot guarantee the security of information in transit to us.

Data breaches

If a privacy breach occurs that has caused or is likely to cause serious harm, we will notify the Office of the Privacy Commissioner and affected people as required by Part 6 of the Privacy Act 2020.

Access and correction

You may ask to see the personal information we hold about you and ask us to correct it. Email support@swmsnz.com. We respond within 20 working days. If you are not satisfied, you may complain to the Office of the Privacy Commissioner (privacy.org.nz) or, in Australia, the Office of the Australian Information Commissioner.

Retention

Order records, including invoices, are kept for seven years to meet Australian tax recordkeeping requirements, and for the period New Zealand requires where that applies to a supply. We keep them for that period so you can rebuild your download links later using the email address you bought with. They are not deleted before then.

The links themselves are short lived: each one is valid for ten minutes, and an order can be reopened a limited number of times. That limits the life of the link, not of the order record behind it.

Enquiry correspondence is deleted once the matter is closed and we no longer need it. If you unsubscribe from marketing we act on it immediately and keep a record that you did, so you are not added again.

Complaints

If you think we have mishandled your personal information, email support@swmsnz.com and we will respond within one working day. If you are not satisfied with our response you may complain to the Office of the Privacy Commissioner at privacy.org.nz, or, in Australia, to the Office of the Australian Information Commissioner.

Changes to this policy

We may update this policy. The date it was last reviewed is shown at the top of this page, and the version in force is the one published at the time.
